OfertariumLegal information — where the data comes from
Ofertarium is not a procurement platform and does not conduct procedures. We collect public procurement notices that public institutions are required to make public, we organize them and describe them. Each procedure card contains a link to the original at the source.

The following services are run by public institutions and provide notice data for reuse, but do not indicate a named license. We only provide what we have verified for them.

Some notices reach us from procurement platforms where contracting authorities publish their procedures. We do not list them here because the terms of reuse are not unambiguous in every case. We treat them as a publication channel for information belonging to the contracting authority: we only retrieve publicly available content, without bypassing logins or security measures, and we always link to the original instead of replacing it.
Basis for reuse
Transparency of the procedure
A public procurement notice is public by law. Publication is a condition for conducting a procedure — without it, no one could submit a bid. The controller of this information is the contracting authority, not the portal through which it was published.
Open data
The reuse of public sector information, including for commercial purposes, is regulated by Directive (EU) 2019/1024 of the European Parliament and of the Council on open data and the reuse of public sector information and the national regulations implementing it. In Poland, this is the Act on Open Data and Reuse of Public Sector Information.
Database right
The aforementioned directive precludes public sector bodies from relying on the sui generis database right to restrict the reuse of information they provide. We do not copy a substantial part of any database — we retrieve individual notices and supplement them with our own analysis.
Attribution
Where reuse conditions require attribution, we comply: each procedure card provides the name of the source and a link to the original notice.
Personal data
Contact details of the contracting authority's representatives sometimes appear in notices. These are sourced from public registers, and we process them only to the extent they were published therein. Requests for removal or rectification should be sent to the address provided below.
