What is a bid bond and when can a contracting authority waive it
A bid bond is a security for a bid: an amount that the contractor submits before the bid submission deadline and loses if, after winning, they evade signing the contract or fail to supplement the required documents through their own fault. It can be submitted in money (by transfer to the contracting authority's account), in the form of a bank or insurance guarantee, or a surety.
The current Public Procurement Law makes the bid bond optional in all proceedings — the contracting authority may require it, but does not have to. If they do require it, limits apply: a maximum of 1.5% of the order value in proceedings below EU thresholds and 3% above them. The refund occurs immediately, no later than 7 days after the conclusion of the proceeding or withdrawal of the bid — but for the entire duration of the procedure, the money stays with the contracting authority, not with you.
In practice, contracting authorities most often waive the bid bond for smaller order values and when they want a larger number of bids. The lack of a bid bond lowers the entry threshold — and we collect exactly these proceedings on this page.

Easier to start — you don't need to commit cash or guarantees. The bid evaluation process itself looks the same as everywhere else: participation requirements, document completeness, and criteria from the tender documents matter. Statistically, however, competition is low: the median is 2 bids per procedure.
How much is the bid bond when the contracting authority requires it?
A maximum of 1.5% of the contract value below EU thresholds and 3% above thresholds. For a contract worth PLN 2 million, this is up to PLN 30,000–60,000 frozen for the duration of the procedure.
When can a contracting authority retain a bid bond?
Primarily when the winning contractor evades signing the contract, fails to provide a performance bond, or fails to supplement documents through their own fault, causing their bid to be rejected. Simply losing a tender never means losing the bid bond — it is returned within 7 days.
Is there sometimes a bid bond in orders up to PLN 130,000?
Orders below 130,000 PLN net are outside the Public Procurement Law, so a bid bond appears there rarely and only if the contracting authority provides for it in the inquiry itself. We have collected them on a separate page with orders up to 130,000 PLN.
